The Subject Property is located along the eastern shoreline of Barnegat Bay at 415 East Bay Avenue in Barnegat, New Jersey within a Commercial/Marine (C-M) zoning district. The Subject Property is an irregular parcel of land (78 ft. by 101 ft.) and consists of one 2,048 square foot, 2.5-story building formerly used as a restaurant establishment; and a one-story shed which was formerly used for cooking operations and/or food preparation. Both buildings are boarded up with limited or no access, are currently unused and remain in poor condition. A timber deck extends from the main building into the Little Egg Harbor Bay, along the existing bulkhead that borders the southern side of the property. The property has an empty non-paved area along the northeast property line with no asphalt pavement present. The landscape of the property appears to have not been maintained for a significant period of time. Gravel areas or bare sandy areas primarily characterize the landscape of the property. The property is currently serviced with municipal utilities: overhead power and telephone, underground natural gas, municipal water and sanitary sewer lines.

Surrounding properties include East Bay Avenue, a kayak establishment, residential housing and salt marshes to the northeast; a sewage lift station, salt marshes and East Bay Avenue to the northwest; Little Egg Harbor Bay to the south; an empty undeveloped lot and Barnegat Bay to the east; and a municipal parking lot, the Barnegat Municipal Dock, boat launch area and boardwalk to the west, with residential housing located further to the west.

E2PM land-use engineers were successful in obtaining local and county planning board approvals for this land development project.
